These Terms of Service constitute a legally binding agreement between you and Promater Inc. By accessing our website, registering for events, or attending any FundayExpo event, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our services or attend our events.

About Our Brands

FundayExpo, Funday Senior Expo, Funday Women Expo, and Funday Girl Expo are all brands of Promater Inc. References to "FundayExpo" or any of these brand names throughout these Terms refer to Promater Inc. and its operations.

1. Acceptance of Terms

By accessing or using the FundayExpo website (fundayexpo.com), registering for any event, or attending any FundayExpo event in person, you ("Attendee," "Vendor," or "User") agree to be legally bound by these Terms of Service ("Terms"), our Privacy Policy, and our Cookie Policy, which are incorporated herein by reference.

These Terms apply to all visitors, users, attendees, vendors, exhibitors, sponsors, and any other persons who access our website or participate in our events.

2. Event Registration & Admission

2.1 Attendee Registration

  • Free Admission: All FundayExpo events offer free admission to registered attendees. No tickets are sold, and no refunds are applicable.
  • Registration Requirement: Pre-registration is strongly recommended. Walk-in attendance is permitted subject to venue capacity.
  • Capacity Limits: Registration does not guarantee entry if the venue reaches maximum capacity. Entry is granted on a first-come, first-served basis.
  • Age Requirement: FundayExpo events are designed for adults aged 50 and older. Attendees under 50 may attend only when accompanying a registered attendee who meets the age requirement.
  • Accurate Information: You agree to provide accurate, current, and complete information during registration.

2.2 Right to Refuse or Revoke Entry

FundayExpo reserves the absolute right to refuse admission or remove any person from any event, without refund or compensation, for any of the following reasons:

  • Failure to comply with these Terms or event rules
  • Disruptive, threatening, or inappropriate behavior
  • Intoxication or apparent impairment
  • Possession of prohibited items
  • Violation of venue policies
  • Any conduct deemed detrimental to the safety, enjoyment, or operation of the event
  • Any other reason at the sole discretion of FundayExpo management

3. Assumption of Risk & Liability Waiver

RELEASE AND WAIVER OF LIABILITY

BY ATTENDING ANY FUNDAYEXPO EVENT, YOU EXPRESSLY AGREE TO THE FOLLOWING RELEASE AND WAIVER OF LIABILITY. READ THIS SECTION CAREFULLY.

3.1 Assumption of Risk

You acknowledge and voluntarily assume all risks associated with attending FundayExpo events, including but not limited to:

  • Personal injury, illness, or death
  • Property damage, loss, or theft
  • Exposure to communicable diseases, including COVID-19, influenza, and other infectious illnesses
  • Slip and fall accidents
  • Food allergies or adverse reactions
  • Interactions with other attendees, vendors, or third parties
  • Physical activities including dancing, walking, and standing for extended periods
  • Exposure to loud music and lighting effects

3.2 Infectious Disease Disclaimer

You acknowledge that attendance at large public gatherings involves inherent risks of exposure to COVID-19 and other communicable diseases. By attending, you:

  • Assume all risks of exposure and illness
  • Agree to follow any health and safety guidelines posted at the event
  • Acknowledge that FundayExpo cannot guarantee a disease-free environment
  • Agree not to attend if you are experiencing symptoms of illness

3.3 Release and Hold Harmless

To the fullest extent permitted by Florida law, you hereby release, waive, discharge, and covenant not to sue Promater Inc., its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, contractors, vendors, exhibitors, sponsors, venue owners, and their respective successors and assigns (collectively, the "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or relating to any loss, damage, injury, or death that may occur as a result of:

  • Your attendance at or participation in any FundayExpo event
  • Your use of any venue facilities
  • Any act or omission of the Released Parties or third parties
  • Exposure to or contraction of any illness or disease
  • Any products, services, or information provided by vendors or exhibitors

3.4 Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your breach of these Terms
  • Your violation of any law or the rights of any third party
  • Your conduct at any FundayExpo event
  • Any claim brought by a third party arising from your actions

3.5 Medical Emergency Authorization

In the event of a medical emergency, you authorize FundayExpo and its representatives to contact emergency medical services on your behalf and consent to receive emergency medical treatment. You agree that all costs associated with such emergency medical treatment shall be your sole responsibility.

4. Code of Conduct

All attendees, vendors, and participants must adhere to the following code of conduct:

4.1 Expected Behavior

  • Treat all persons with respect and courtesy
  • Follow all venue rules and staff instructions
  • Maintain appropriate attire suitable for a public event
  • Respect personal space and boundaries of others
  • Dispose of trash and recycling properly

4.2 Prohibited Conduct

  • Harassment, discrimination, or intimidation of any kind
  • Violence, threats, or aggressive behavior
  • Unauthorized solicitation or sales
  • Distribution of unauthorized promotional materials
  • Disorderly conduct or public intoxication
  • Illegal activity of any kind

4.3 Prohibited Items

The following items are strictly prohibited at all FundayExpo events:

  • Weapons of any kind (firearms, knives, etc.)
  • Illegal drugs or controlled substances
  • Outside alcoholic beverages
  • Large bags, backpacks, or coolers (subject to search)
  • Professional photography/video equipment (without prior authorization)
  • Drones or unmanned aerial vehicles
  • Laser pointers
  • Any item deemed dangerous or disruptive by event staff

5. Photography & Media Release

NOTICE: PHOTOGRAPHY AND RECORDING IN PROGRESS

FundayExpo events are photographed and video recorded for promotional and archival purposes. By entering the event, you consent to being photographed, filmed, and/or recorded.

5.1 Grant of Rights

By attending any FundayExpo event, you grant to Promater Inc. and its affiliates an irrevocable, perpetual, worldwide, royalty-free license to:

  • Photograph, film, and record your image, likeness, voice, and actions
  • Use, reproduce, modify, and distribute such photographs, films, and recordings
  • Use your image and likeness in any media format now known or later developed
  • Use such materials for marketing, advertising, promotional, educational, or any other lawful purpose

5.2 Waiver of Rights

You waive any right to:

  • Inspect or approve any photographs, videos, or recordings before use
  • Compensation for the use of your image or likeness
  • Make claims based on rights of privacy, publicity, or personality

5.3 Social Media

You authorize FundayExpo to use photographs or recordings featuring your likeness on social media platforms including but not limited to Facebook, Instagram, YouTube, LinkedIn, and TikTok.

5.4 Opt-Out

If you wish to limit your appearance in photographs or recordings, please notify event staff upon arrival. While we will make reasonable efforts to accommodate your request, we cannot guarantee complete exclusion from background appearances in wide-angle shots or group photographs.

6. Event Changes & Cancellations

6.1 Right to Modify

FundayExpo reserves the right to modify, reschedule, or cancel any event, or any aspect thereof, at any time and for any reason, including but not limited to:

  • Changes to event date, time, or location
  • Changes to event schedule, performers, entertainment, or activities
  • Changes to vendors, exhibitors, or sponsors
  • Changes to event format (indoor/outdoor, in-person/virtual)

6.2 Force Majeure

FundayExpo shall not be liable for cancellation or postponement due to circumstances beyond our reasonable control, including but not limited to:

  • Acts of God (hurricanes, floods, earthquakes, severe weather)
  • Pandemics, epidemics, or public health emergencies
  • Government orders, regulations, or restrictions
  • Civil unrest, terrorism, or threats thereof
  • Venue unavailability or damage
  • Utility failures or technical malfunctions
  • Labor disputes or strikes

6.3 No Guarantee of Specific Vendors

FundayExpo does not guarantee the presence of any specific vendor, exhibitor, performer, or sponsor at any event. Vendor participation is subject to change without notice.

7. Vendor Responsibilities

Vendors, exhibitors, and sponsors participating in FundayExpo events agree to the following:

7.1 General Obligations

  • Provide accurate and truthful information about products and services
  • Maintain all required business licenses, permits, and insurance
  • Comply with all applicable federal, state, and local laws and regulations
  • Refrain from making false, misleading, or deceptive claims
  • Respect attendee privacy and comply with all data protection laws
  • Maintain professional conduct at all times

7.2 Setup & Operations

  • Arrive and set up within designated timeframes
  • Remain operational during all event hours
  • Tear down and vacate within designated timeframes
  • Keep booth areas clean and presentable
  • Not extend beyond assigned booth space

7.3 Insurance Requirements

Vendors may be required to maintain comprehensive general liability insurance with minimum coverage as specified in the Vendor Agreement. Proof of insurance must be provided upon request.

7.4 Vendor Cancellation

  • Cancellations made 30+ days before the event: 50% refund
  • Cancellations made less than 30 days before the event: No refund
  • No-shows: No refund and may affect future participation eligibility

8. Intellectual Property

All content on the FundayExpo website and at our events, including but not limited to text, graphics, logos, images, videos, audio, software, and trademarks, is the property of Promater Inc. or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not use, reproduce, distribute, modify, display, or create derivative works from any content without prior written permission from Promater Inc.

9. Third-Party Interactions

9.1 Vendor Transactions

FundayExpo is not a party to any transactions between attendees and vendors. Any purchases, agreements, or disputes arising from interactions with vendors are solely between you and the respective vendor. FundayExpo makes no representations or warranties regarding:

  • The quality, safety, or legality of products or services offered by vendors
  • The accuracy of information provided by vendors
  • The ability of vendors to fulfill their obligations

9.2 Third-Party Links

Our website may contain links to third-party websites. These links are provided for convenience only. FundayExpo does not endorse and is not responsible for the content, accuracy, or practices of any third-party websites.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

IN NO EVENT SHALL PROMATER INC. OR ANY OF THE RELEASED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR ATTENDANCE AT ANY EVENT, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR WHETHER PROMATER INC. WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE TOTAL LIABILITY OF FUNDAYEXPO FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR ANY EVENT SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

11. Governing Law & Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

11.2 Jurisdiction & Venue

Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida. You consent to the personal jurisdiction of such courts and waive any objection to venue.

11.3 Attorney's Fees

In the event of any legal action to enforce these Terms, the prevailing party shall be entitled to recover reasonable attorneys' fees and costs from the non-prevailing party.

12. General Provisions

12.1 Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and FundayExpo regarding your use of our services and attendance at our events, and supersede all prior agreements and understandings.

12.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

12.3 Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. FundayExpo's failure to enforce any provision of these Terms shall not constitute a waiver of that provision.

12.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without FundayExpo's prior written consent. FundayExpo may assign these Terms without restriction.

13. Changes to Terms

FundayExpo reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services or attendance at our events following the posting of changes constitutes your acceptance of such changes.

We encourage you to review these Terms periodically. Material changes may be communicated via email to registered users or through prominent notice on our website.
